The provincial government is seeking input on a new trustee act.
The intent is to provide an updated set of rules governing trustees' duties and powers, the administration of trusts and powers of the court to intervene in a trust.
It will be based on the Uniform Trustee Act, developed by the Uniform Law Conference of Canada (ULCC), designed to be used in all Canadian common-law jurisdictions - namely all provinces and territories except Quebec.
Both the Uniform Trustee Act and the ULCC's final report on the proposed legislation can be found at www.ulcc.ca while the British Columbia Law Institute's report is posted at www.bcli.org. Information about the consultation is available at www.ag.gov.bc.ca.
The law of trusts pertains to several areas: wills and estates, protecting the property of children or vulnerable persons, the sale and purchase of real property, commercial transactions, investing,
managing pension funds and charities and other not for profit purposes.
