Columbus Hotel owner wins a break in court

A B.C. Supreme Court justice has turned down the city's request for a "summary judgment" that would have compelled the previous owner of the Columbus Hotel to pay slightly more than $175,000 for the cost of demolishing and cleaning up the Third Avenue downtown site.

The ruling means the matter will have to go to a full-fledged trial.

Lawyer Oliver Hui, who represented the city, said Justice J. Willcock dismissed all the defences the Columbus' previous owner, Rob Gibson, raised for not paying the bill, but "raised an additional twist."
