City accepts Haldi school ruling

It's back to the drawing board for the team wanting to create a treatment centre at the former Haldi Road elementary school.

It's back to the drawing board for the team wanting to create a treatment centre at the former Haldi Road elementary school.

The city has decided not to appeal the Supreme Court decision handed down last week, which threw out last December's rezoning of the Leslie Road property to facilitate the Northern Supportive Recovery Centre for Women.

The ruling on the legal challenge, brought forward by Leslie Road resident Janice Sevin, is that the rezoning was inconsistent with the city's Official Community Plan and therefore contrary to the Local Government Act.

This leaves the property with its original zoning - rural residential - which permits, a community care facility housing with six residents at most. The proposed centre would have accommodated 30, as well as 10 staff and visitors.

"They'd have to start the whole process from scratch, resubmitting an application and then there would be a whole public process," said Ian Wells, the city's acting director of planning and development.

Wells said he has not heard whether or not a new application for an OCP amendment is forthcoming.

A representative for the Northern Supportive Recovery Centre did not return a request for comment by press time.
