A Prince George youth has successfully fought a 24-hour driving suspension issued against him because an RCMP officer thought he had been smoking marijuana.
An order striking down the suspension was issued this week following a hearing in B.C. Supreme Court in Prince George.
According to an affidavit, the youth said he was sitting in the driver's seat of a parked car smoking an e-cigarette, also known as a vaporizer while two friends were also in the car.
"The officer knocked on the window and stated to me words to the effect of 'I smell dope. You're under arrest for possession. Get out of the car.'"
The suspension had been issued in January and a petition seeking to strike it down was issued a month later.
Under the graduated licensing program, novice drivers who have been issued a 12-hour suspension for alcohol or a 24-hour suspension for drugs must start over at the beginning of their two-year licensing period and learners must reattempt all testing.
