A judge backed away Tuesday from ordering a psychological assessment for a violent criminal after the subject made it clear he would not cooperate.
But in making the decision, Judge Darrell O'Byrne warned Timothy Shawn Preddy that his refusal to consent will be taken into account during sentencing.
"Mr. Preddy refuses the opportunity to enhance the court's knowledge at sentencing at his peril," O'Byrne said during the hearing.
