Sentence reduced in courthouse attack

The B.C. Court of Appeal has granted a break on the sentence for a man who punched a local Crown prosecutor near the steps of the Prince George courthouse.

In April 2013, Adrian Real Bergeron was sentenced to five years for intimidation of a justice system participant for the September 2011 attack that left Alex Schmeisser unconscious and with injuries that required extensive surgery.

Bergeron had spent 587 days in custody at that point but did not receive a full 1.5 days credit for each day served prior to sentencing.

Instead, he was given two years credit, meaning the time he still had to serve was three years.

On Wednesday, the Court of Appeal issued a decision that increased Bergeron's credit for pre-sentence custody to 881 days, reducing the remainder of the sentence to two years and 215 days.

The decision was made in accordance with a 2014 Supreme Court of Canada ruling related to credit for pre-sentence custody.
