Proposed change to Indian Band's trust turned down

A B.C. Supreme Court Justice rejected this week a proposal from the McLeod Lake Indian Band to vary the terms of a trust established from the proceeds of its 2000 treaty settlement.

A B.C. Supreme Court Justice rejected this week a proposal from the McLeod Lake Indian Band to vary the terms of a trust established from the proceeds of its 2000 treaty settlement.

Specifically, in a reasons for judgment reached Wednesday in Vancouver, Justice Stephen Kelleher turned down a request to reduce to the inflation rate only an obligation to increase each year the trust's principal by three per cent plus inflation.

The court became involved because the change will affect future band members, not just those currently alive. At its inception, the trust stood at $22.8 million.
