The name of Mayor Shari Green has been removed from a lawsuit launched in response to city council's decision to allow the Northern Supportive Recovery Centre to go ahead.
Following a notice that an allegation of conflict of interest against Green has been "abandoned," her name was crossed out in an amended petition, filed Monday at the Prince George courthouse.
The updated petition also includes a new claim - that the city's zoning bylaw contravenes the Local Government Act because it creates an "unnamed" zoning district by limiting community care facility - therapeutic, to one parcel.
It's also claimed the bylaw is invalid because the addition of community care facility, therapeutic to the AR2 zoning district "creates a direct and absolute collision" with certain mandatory use and density of use regulations contained in district and "renders such amendment incapable of application."
The petitioners in the lawsuit are seeking to quash council's April decision to rezone land at 5877 Leslie Road to allow construction of the 30-bed residential women's therapeutic facility, Pettersen said.
A previous council vote in favour of the centre was overturned when a B.C. Supreme Court judge ruled the attempt to rezone the property violated the official community plan. In response, council amended the plan following a public hearing, in addition to passing a zoning amendment.
A few weeks after the final vote in April, Tore Pettersen filed a notice of claim contesting the outcome. Ten more people have since added their names to the petition.
The petitioners also continue to claim the decision remains invalid because it's inconsistent with the city's official community plan and council's amendment is "internally inconsistent" with city policies.
