A Chilliwack man has been sentenced to 30 months in prison followed by a two-year driving prohibition for fatally striking down a former Prince George man with his pickup truck.
Gary Allain, 64, was issued the term Nov. 12 for an Aug. 15, 2012 incident that ended with the death of Darcy Garnot, the Chilliwack Times reported.
According to the Times, Garnot had been living in the Fraser Valley community after becoming estranged from the mother of his two children. That night, he had been drinking with friends and was angry he couldn't be in Prince George for his father's birthday.
He was walking along a road with a girlfriend when he had a brief encounter with Allain. A witness saw Allain knocked to the ground and his small dog go flying into the air.
Moments later, Allain was behind the wheel of his pickup truck and struck Garnot as he was talking on his cellphone while on the side of the road. Garnot was taken to Chilliwack General Hospital where he was pronounced dead.
A witness noted six out of seven digits later matched to the licence plate on Allain's truck. Some 15 hours afterwards, Allain was arrested.
"We would not be here today if not for the apparent lack of control of the accused," B.C. Supreme Court Justice Joel Groves said in a sentencing decision. "He could have called 911. He could have walked away. He could have driven by and had a verbal exchange and been done with it."
