A Prince George man was found guilty Monday of sexually assaulting his ex-boyfriend.
B.C. Supreme Court Justice Margot Fleming found the man, whose name is protected by a court-ordered publication ban against information that would identify the victim, forced non-consensual sex on the victim.
The decision was made following a trial in which much of the evidence was in the form of the victim's testimony but was also corroborated by other witnesses. Fleming also found that while the victim had been drinking heavily, he was still sober enough to accurately perceive what was going on.
The assailant was found not guilty of sexual assault causing bodily harm because there was a reasonable possibility that an injury the victim suffered could have occurred during a session of consensual sex before he was attacked.
However, the assailant was also found guilty of common assault after Fleming found other injuries the victim suffered matched with his story that he had been slapped across the face four times, the last blow strong enough to knock a lens out of his glasses.
Fleming found the assailant used his considerable size and weight advantage in having his way with the victim.
The incident occurred in the assailant's home in June 2012. The two had been in an on-again, off-again relationship and, after a night out at some local nightspots, the victim agreed to drop by the assailants home where a discussion about their relationship turned into an argument.
The assailant will be sentenced at a later date following completion of a pre-sentence report.
