Justice rejects lawsuit against doctors

A B.C. Supreme Court judge has dismissed a lawsuit brought against two Prince George physicians by a mother who contended a delay in receiving a caesarian section led to an ear infection and trouble breast feeding for her baby and post-pregnancy depression for her.

In a reasons for judgement, Justice Neill Brown agreed with expert testimony that the troubles Neveen Mikhail, 33, and her son suffered were not the result of the care she received from Dr. Maria Odulio and Dr. Paul Murray during the delivery in late October 2006.

Mikhail based part of her case on a report from ear, nose and throat specialist who practices in Egypt. The specialist found the boy suffered a recurrent middle ear infection and found bottle feeding to be the major cause.

But Brown noted the specialist did not comment on the standard of care provided by Odulio and Murray and failed to provide both the facts behind his finding and his qualifications to be a specialist.

Mikhail also relied on a report from a psychiatrist who found that her prolonged and complicated delivery likely resulted in symptoms of depression and anxiety. However, Brown noted that nowhere in the report is any basis for finding negligence spoken of.
