Hearts and Hands for Homes appeal dismissed on all counts

The B.C. Court of Appeal issued its reasons Friday for its February decision to deny a request to overturn a B.C. Supreme Court Justice's decision ordering Prince George-based Hearts and Hands for Homes Society turn over its assets to Habitat for Humanity Canada.

According to the document, the Court of Appeal rejected on all counts HHH's arguments that the matter was not suitable for a summary trial and that the judge misapprehended key evidence from HHH.

The appeal from HHH was dismissed on Feb. 15, the same day a hearing on the matter was held.

Formerly known as Habitat for Humanity Prince George, HHH was disaffiliated from Habitat for Humanity Canada in September 2013 because it failed to live up to standards the national organization had in place regarding governance and operations.

Habitat for Humanity Prince George subsequently changed its name to Hearts and Hands for Homes Society.

In July 2015, B.C. Supreme Court Justice Neena Sharma found Habitat Canada was entitled to disaffiliate the local group and ordered HHH to hand over its assets to the national organization.

The non-profit Habitat movement provides housing, built by volunteers, to low-income families. Habitat Prince George was incorporated in 2001.

Habitat Canada had also since filed a request seeking a contempt of court order against two of HHH's directors over the local group's move to reopen the old ReStore under a new name. But that application was adjourned generally on May 5.
