A date has been tentatively set to hear arguments over whether city council's April decision to allow the Northern Supportive Recovery Centre to go ahead should be quashed.
A notice of hearing setting Sept. 30 as the first day of a two-day hearing has been filed at the Prince George courthouse by lawyer Roy Stewart, representing Haldi Road area resident Tore Pettersen.
The notice was given after parties have been unable to agree on a date, according to the filing.
A few weeks after city council voted in favour of rezoning land at 5877 Leslie Road for the 30-bed residential women's therapeutic facility, resident Tore Pettersen filed a filed a notice of claim contesting the outcome.
Pettersen and 10 other residents who have since put their names to the action, claiming the decision remains invalid because it's inconsistent with the city's official community plan and council's amendment to the OCP is "internally inconsistent" with city policies.
An allegation previously included in the claim, that Mayor Shari Green was in a conflict of interest when she voted on the issue, has been discontinued.
