A former Prince George father says he will drop his lawsuit against School District 57 over its decision to allow his children to be transferred to a school where their mother works without his permission.
"I have no time or resources to fight this in court," he said in an email to The Citizen. "I am going to dismiss my court case and bring this before the B.C. Omsbudperson again. I filed an official complaint there before, but they could not continue once it was brought to court."
In late November, the father, who will not be named to protect the children's identities, filed a notice seeking a court order forbidding her from working in the same school the children are attending.
In a response filed in December, the school district said the transfer was made for "no improper purpose and with no improper motivation" and contended that the plaintiff knew the move would not have been made if he provided for daycare costs.
Last Friday, counsel for the school district filed a notice of application seeking to have the claim struck on the basis that it is unreasonable, an abuse of court process and unlikely to succeed.
The father lived in Prince George at the time he initiated the action but has since moved away.
