In the trial of a Prince George gangster accused of sexual assault, the alleged victim's friend testified Wednesday that she didn't see the incident in question.
Sabrina Powar contradicted herself during the course of her testimony, first saying she "was taken aback" when the victim fondled a fellow party guest's brandished penis during a brief three-way make-out session allegedly going on between Joey Arrance, Vishnu Sharma and the female victim, who cannot be named by court order.
Then later Powar insisted she had seen no such thing, and had not mentioned it to police when interviewed about the events of that contentious night.
Powar was a mutual friend who brought the complainant to the small party that night at the Renegades Clubhouse.
Arrance was, at the time of the incident, a junior member or "striker" with the Renegades Motorcycle Club, an affiliate of the Hells Angels and Game Tight Soldiers organized crime groups.
Vishnu, known by the nickname "Squish," was an associate of Arrance's.
Following Powar's testimony, defence counsel Patricia Connor in her final submissions Wednesday.
She suggested the victim's story had too many holes in its chronology and there was, in her view, evidence that her answers had been coached by police and/or Crown.
"It would be dangerous to convict Mr. Arrance on the evidence before you," Connor told Judge Michael Gray.
Crown prosecutor Lara Vizsolyi countered that the victim's memory faults were confined to minor chronological blips and were more than matched by Arrance's and Powar's inconsistencies.
She added the only information police provided the victim was the proper name of the alleged assaulter.
Furthermore, she said, the alleged victim was forthright in her testimony, that it fit with the evidence of the physician who examined her following the incident, and her testimony painted a picture of a someone who "was quite clear that she said no, that she said it over and over again, that she did not give consent."
The three-day trial heard from Arrance, who insisted sex had occurred between him and the complainant the night of July 21, 2010 but it was fully consensual. The alleged victim testified the sex was forced upon her despite her verbal protests and upset emotions. A physician testified briefly that the complainant had a genital abrasion that would have caused her significant pain and was consistent with either extremely vigorous consensual sex or forced penetration.
Gray said he would need time to sift through the testimony therefore a verdict would not be reached until sometime in late October or early November at a time to be decided among himself and the legal teams involved.
