CINCINNATI - Procter & Gamble Co. has filed a lawsuit against private label manufacturer RNA Corp. alleging infringement of the trademark, trade dress and design patents for its Herbal Essences hair-care products.
The Cincinnati-based consumer products company filed the suit Thursday in U.S. District Court in Cincinnati. P&G claims RNA of Blue Island, Ill., is distributing shampoo and conditioner products under the name Hydrating Herbal Shampoo and Hydrating Herbal Conditioner.
P&G believes RNA is selling the products in packages that copy the Herbal Essences packaging to capitalize on the brand's success and consumer loyalty. P&G wants RNA ordered to stop distributing the products, request the recall of inventory from store shelves and destroy the bottle moulds
A message seeking comment was left at RNA's headquarters Thursday.
